October 31, 2026, is the deadline for submitting qualifying label exemption requests under New Mexico's PFAS regulation, according to the New Mexico Environment Department (NMED). The National Marine Manufacturers Association (NMMA) has reminded manufacturers of the deadline as they assess requirements for products sold in the state.
The regulation requires products containing intentionally added PFAS to carry a specified label when sold in New Mexico. Beginning January 1, 2027, intentionally added PFAS will also be prohibited in certain products.

The exemption request deadline and the January prohibition concern different aspects of compliance. A labeling exemption request relates to the labeling requirement; it should not be assumed to exempt a product from the separate restriction on intentionally added PFAS.
For manufacturers, the immediate question is whether their products qualify for a labeling exemption and whether a request has been submitted by the deadline. The next issue is whether any of their products fall within the categories subject to the January restriction. The effects on product labeling and sales will depend on how those requirements apply to each product.
